Terms & conditions of sale

Article 1 — Purpose
These General Terms and Conditions of Sale (the "Terms") govern all contractual relations between AEROTRADITION (EI Wach Alisa, SIRET 842 737 025 00069, located at 80 Chemin du Grand Caboit, 84150 Violès) and any individual or legal entity wishing to order custom goodies (the "Client").
Any order implies the Client's unreserved acceptance of these Terms.
Article 2 — Products
AEROTRADITION designs and manufactures custom goodies for military squadrons, aviation companies and enthusiasts: patches (3D PVC, embroidered, woven, leather, felt, sublimated), leather name tapes, coins, pins, lanyards, pennants, banners, t-shirts, mugs, stickers.
MOQ (minimum order quantity): 100 pieces per reference. The visuals shown for illustration are not contractual — a visual proof (artwork proof) is systematically provided before production.
Article 3 — Quotes and orders
Every project is the subject of a free personalised quote, valid for 30 days from its issue. The quote details the product, the quantity, the unit price excl. VAT, the total excl. and incl. VAT, and the indicative lead times.
The order is firm and final upon receipt of the quote signed by the Client (electronic or physical signature) and full payment of the amount including VAT. Manufacturing only starts once the Client has validated the visual proof.
Article 4 — Prices
Prices are expressed in euros, excluding tax (excl. VAT) and excluding shipping costs. French VAT at the rate in force (20%) applies to domestic sales.
Special cases:
- Intra-community B2B sales (with a valid VAT number): invoice under the reverse-charge mechanism (0% VAT, art. 262 ter of the French Tax Code)
- Sales outside the European Union: 0% VAT (export, art. 262.I of the French Tax Code)
- Sales under DETAM (tax exemption for armed forces on operations): 0% VAT (art. 293 B of the French Tax Code)
Article 5 — Manufacturing and delivery lead times
Standard lead times are 3 to 4 weeks after validation of the visual proof and receipt of payment, barring logistical contingencies. These lead times are indicative. AEROTRADITION undertakes to inform the Client of any foreseeable delay.
Delivery worldwide, including overseas operations (OPEX). The shipping method and costs are specified on the quote depending on the destination.
Delivery is carried out by carrier (La Poste, Chronopost, FedEx, DHL, UPS, DPD depending on destination) with a tracking number sent automatically by WhatsApp.
Risk is transferred to the Client when the parcel is handed over to the carrier. The Client must check the condition of the parcel on receipt and raise any reservations with the carrier within 3 days (French Commercial Code L133-3).
Article 6 — Payment
Payment is made by:
- SEPA transfer (bank details provided with the quote)
- Card via Stripe (secure link on request)
- Administrative order (public / military clients)
Standard terms: full payment on order. Manufacturing starts as soon as payment is received and the visual proof is validated.
Any late payment results, in accordance with article L441-10 of the French Commercial Code, in the application of penalties at the ECB rate increased by 10 points and a fixed recovery indemnity of €40, without prejudice to any other course of action.
Article 7 — Right of withdrawal
Custom products do NOT benefit from the right of withdrawal pursuant to article L221-28 3° of the French Consumer Code (goods made to the consumer's specifications or clearly personalised).
The validated visual proof constitutes the Client's final commitment to the artwork and specifications.
Article 8 — Warranties and conformity
Products are guaranteed to conform to the validated visual proof. Any non-conformity (manufacturing defect, quantity error, discrepancy with the visual proof) must be reported in writing within 7 days of delivery, accompanied by photos.
AEROTRADITION undertakes, at its discretion, to take back, remake or refund non-conforming items. Usual manufacturing tolerances (≤ 3% on dimensions, slight variations in shade) do not constitute a non-conformity.
Article 9 — Intellectual property of artwork
The Client warrants that it holds the necessary rights to the logos, crests, trademarks or artwork supplied for manufacturing. It indemnifies AEROTRADITION against any third-party claim in this respect.
AEROTRADITION never publishes military squadron artwork without the explicit agreement of the unit's command. Consumer artwork may be used for commercial reference purposes, unless the Client expressly objects.
Article 10 — Personal data
The personal data collected is processed in accordance with the GDPR policy detailed in the legal notice.
Article 11 — Mediation and disputes
In the event of a dispute, the Client is invited to contact AEROTRADITION first to seek an amicable solution. Failing this, the Client may use a consumer mediator free of charge: Médiation.fr (mediation.fr).
In the absence of an amicable resolution, any dispute shall fall within the exclusive jurisdiction of the courts of the Avignon district (84). French law is solely applicable.
